• W3164020201 abstract "תקציר בעברית: בישראל נרשם לאומו של כל תושב במרשם האוכלוסין. אולם מה הן ההשלכות של רישום על התושב הישראלי? האם הרישום עומד בקנה אחד עם הזכויות החוקתיות של הפרט בישראל? האם אדם יכול להיות חסר או לכל הפחות להצהיר על כל לאום בתום לב? שאלות אלה, ורבות אחרות, נותרות ללא מענה בחקיקה, בספרות המשפטית ובפסיקה כבר עשרות שנים, ונדמה שהערפל המשפטי האופף את הנושא מציב את ישראל במקום בעייתי ביחס למגמת הביטול של רישום במדינות העולם הדמוקרטי. במאמר זה ננסה לענות על שאלות קריטיות אלה ולהפיג מעט מן הערפל המדובר. תחילה נסקור את תולדות התפתחותו של רישום בישראל, את המטרות המקוריות שהנחו את מקימי המדינה בקביעתו, ואת המטרה הסטטיסטית שיוחסה לו במפורש על ידי בית המשפט העליון. לאחר מכן נבהיר כיצד רישום הנוכחי אינו מגשים מטרות אלה, ובמקום זאת משליך מבחינה חוקתית-מהותית על חיי הפרט ופוגע בזכויותיו לכבוד ולשוויון. באופן דומה נבהיר מדוע הרישום אינו תואם עוד לזכות החוקתית של הפרט לשלמות נפשית, לחשיבות של תחושותיו הסובייקטיביות והגדרתו העצמית, או למעמד של זכויותיו החוקתיות לאוטונומיה ולחופש מצפון. בהמשך, לאחר שנערוך סקירה משווה מפורטת ביחס לרישום במדינות העולם, נשתמש בפרשת הלאום הארמי כמקרה בוחן להדגמת טענותינו. לבסוף נתאר הצעות שונות שלנו העשויות להפיג ולו מעט מן הערפל המשפטי השורר סביב הליך הרישום; נביע את דעתנו ביחס לאפשרות הרישום כחסר לאום, לרישום עוללים ולרישום זכאי חוק השבות; ונסביר מדוע לדעתנו תכליות דתיות-פוליטיות הן שעומדות בבסיס רישום בישראל, ולא תכליות סטטיסטיות או רב-תרבותיות.English Abstract: In Israel, the registration of every resident involves a classification of his or her Leom. is roughly translated into peoplehood – and relates to a person's ethnic and cultural origin. However, the question arises: what are the ramifications of such registration? And is such registration compatible with the constitutional rights of the individual in Israel? Can an Israeli be registered being without a Or can he, at least choose bona fide any Leom? Such questions, well many others, remain unanswered in Israel's laws and judicature. These very questions place Israel in a problematic stance compared with trends to eliminate such registration and classification in other democracies. In this article, we shall try to answer these crucial questions and disperse the surrounding them. We shall first summarize the historical development of the subject in Israel and find out what were the main purposes lying behind this registration, and its main statistical purpose as established by the Supreme Court. Then, we shall discuss the question how far this law fulfills presently these purposes, or instead, interferes constitutionally with the individual right to dignity and equality, well with his right to autonomy, self-determination and freedom of conscience. Consequently, after a comparison with other democracies in the world, we shall refer to the Aramaic a test case proving our propositions. Finally, we shall express our views on various proposals to reform the law, to eliminate or decrease the legal fog surrounding the issue. In addition, we shall discuss the possibility of no Leom registration; the registration of minors; and the registration of new Olim, who are not considered Jewish by Halachic law. Then, we will show that behind this registration, stands political and religious motives, which have nothing to do with statistics." @default.
