But what happens when 3D printing is used for the manufacture of a firearm? In 2013, Cody Wilson of Defense Distributed fired the first gun made from nearly all 3D-printed parts and posted the design online, where it was downloaded over 100,000 times in two days. At the time, no laws specifically prohibited 3D-printed guns. The State Department requested the model be taken offline, asserting that Wilson needed a license under the International Traffic in Arms Regulation (ITAR). Defense Distributed filed for an injunction, arguing that the State Department infringed on its First Amendment rights. Defense Distributed lost at trial and on appeal at the Fifth Circuit. However, the case settled—with the State Department waiving the license requirement against Defense Distributed, allowing them to publish the files freely. This settlement left the door open for Defense Distributed and others to continue to distribute blueprints online. This Comment analyzes why the ITAR is a prior restraint, why the distribution of 3D gun blueprints is protected conduct, and other reasons that make the ITAR unenforceable under the First Amendment. 3D gun technology continues to develop with legislation close behind. As government bodies attempt to address the threat of 3D-printed guns, this Comment aims to shed light on the weaknesses of the ITAR so that future laws and regulations are bulletproof against a First Amendment challenge." @default.
