- W3167493722 abstract "In this essay, I develop a framework for courts seeking to determine whether a regulatory investigation by Congress (of the private sphere, as opposed to which is of the Executive branch) is justiciable or is, in fact, by prior oversight. The framework seeks to rethink the longstanding accommodation doctrine relied upon by the D.C. Circuit. In recognizing that accommodation is a form of administrative exhaustion, this essay argues that for any regulatory investigation that began as an oversight matter, congressional attempts to judicially enforce investigative requests would be non-justiciable so long as the regulatory investigation is tainted - an administrative doctrine recognized by the D.C. Circuit. Such exists whenever Congress made the choice to pursue oversight, has not yet remedied its oversight complaint politically (exhaustion and ripeness) and yet has made a subsequent to choice to pursue information via a regulatory investigation of a private company and judicial review thereof. In order for Congress to remove political taint from an otherwise legitimate regulatory investigation, it must show that it exhausted its political remedies: impeachment, appropriations restrictions, or other sanctions that are aimed at forcing concessions from the Executive branch. In this sense the accommodation doctrine is revised as a form of political exhaustion that fully recognizes that oversight involves political questions committed to resolution between the branches. With this background, the current dispute before the Supreme Court - Trump v. Mazars - is not justiciable because Congress used antecedent political oversight: information requests to GSA and OGE, a GSA IG investigation, litigation against the GSA Administrator, testimony of Michael Cohen, and emoluments litigation yet has not shown that it has exhausted its political remedies in such a way as to untaint its present subpoena to Mazars." @default.
