- W3168256508 abstract "Rawls traces the roots of as to Kantian ethics but maintains that he must move beyond Kantian Philosophy to synthesize practical principles and render a conception of justice. I will argue that one need not move past Kant's ethical and political theory to synthesize political principles with concrete policy applications. The purpose of this essay is to set out the Framework of a rival for Rawl's as that can be used to analyze and make public policy choices. I will argue that Kant's moral and political theory, which provides a point of departure for Rawls, can, in itself, provide the analyst with a distinct set of maxims and a unique standard for the just state that characterize what I will call Justice-From-Autonomy.In order to see the distinct qualities of the Kantian approach, I will set up a three-component framework for the comparison of Rawls and Kant. I will assume that any application of moral theory to political choice necessitates a description of the individual^ the collective action problem that generates the principles by which individuals cooperate by balancing their rights against the good of the community, and the legitimate state which establishes the maxims of the policy-maker in the Standards by which justice will be defined. These components of the analytical framework will be examined individually and both Kant's and Rawls' constructions for each will be compared and contrasted. As these foundational assumptions are set out, I will show how each approach to justice renders distinct principles for policy choice and how these principles, while providing maxims for the Rawlsian decision-maker to seek an overlapping consensus, justify the Kantian analyst to empower individual moral agency through fulfillment of a baseline function that defines the conditions necessary to autonomy in terms of minimum allotments of public and private goods, environmental quality and the opportunity to use them.Overall, I will argue that there is a consistent evolution of thought when Rawls' work is seen as amending a distinctly Humean approach to justice rather than as adjustments to Kantian moral theory. By comparing and contrasting Justice as Fairness with Justice-From-Autonomy (hereafter JA), I will suggest that, if the foundation of the former is seen as Hume's theory of justice rather than Kant's, then the most recent stage of Rawls' thought can be described as a refinement of a core line of argument that was evident in his earlier work." @default.
