- W3177064165 abstract "This chapter is an examination of the Eritrea Ethiopia Claims Commission (“EECC”) through a transitional justice lens, exploring the potential for such international dispute resolution mechanisms to achieve transitional justice goals such as accountability, peace and reconciliation in the aftermath of armed conflict and mass atrocity situations. While much has been written about the EECC and its efficacy as an ad hoc arbitral commission established in the line of historic “mixed commissions” for purposes of settling inter-State claims through application of international legal rules on state responsibility, less attention has been given to the EECC as a mechanism also established for redress for victims in the face of mass atrocities devastating whole communities. This is surprising given the Commission’s explicit mandate under the treaty ending a bitter armed conflict between Eritrea and Ethiopia, the Algiers Agreement of 12 December 2000, to award compensation to civilians and prisoners of war who suffered greatly as a result of serious violations of international humanitarian law during the conflict. As such, this chapter addresses what is meant by a transitional justice mechanism, judicial or non-judicial, and what are the purported goals to be achieved by such processes, particularly in the aftermath of armed conflict or mass atrocity situations. Second, in outlining the origins and structure of the EECC, this chapter queries whether the Commission may be considered a transitional justice mechanism as traditionally understood, and where it fits within the typology for such mechanisms in the literature and in practice. Third, this chapter examines what lessons can be learned from the EECC’s work, both positive and negative, from a transitional justice perspective, and whether the EECC experiment might be instructive for establishing a model for future ad hoc arbitral commissions established at least in part to achieve transitional justice goals. Finally, this chapter concludes by considering, in light of the EECC precedent, whether the ad hoc arbitral commission might serve in future as an important complement or supplement to the current work of international tribunals assigning individual criminal responsibility or State responsibility for armed conflict or atrocity situations such as the International Criminal Court and the International Court of Justice. In this vein, this chapter explores whether ad hoc arbitral commissions established as a matter of course pursuant to peace agreements between States or non-State entities, might provide for more holistic, localized justice specifically tailored to address situations involving thousands of alleged perpetrators and hundreds of thousands of victims which are beyond the capacity of the ICJ or existing international or national justice processes to address." @default.
