• W3181130337 abstract "German Abstract: Hegels Volkerrechtstheorie wurde und wird sehr ambivalent rezipiert. Die Bandbreite reicht vom Vorwurf der Leugnung des Volkerrechts bis hin zur Weiterentwicklung seiner Ansatze vor dem Hintergrund des verflochtenen, globalen Rechts. Der vorliegende Beitrag analysiert Hegels Theorie des „auseren Staatsrechts“. In der Interpretation seiner rechtsphilosophischen Hauptschrift wird dargelegt, wie sich die rechtliche Normativitat des Volkerrechts bei Hegel aus seiner Vernunftphilosophie ergibt. Aufgrund Hegels Anliegen, die Partikularitat der Akteure und die Allgemeinheit der Rechtsform miteinander zu vermitteln, scheint seine Theorie auch fur aktuelle volkerrechtstheoretische Diskurse attraktiv. Sie ermoglicht, macht- und interessensbasierte Ansatze der internationalen Beziehungen mit normativen Grundlagen des Volkerrechts auszusohnen. In einem zweiten Schritt wird diese Erorterung um eine Rezeptionsgeschichte erganzt. Seit dem 19. Jahrhundert dauern die Debatten um Hegels Volkerrechtsdenken an und es zeigen sich verschiedene Wahrnehmungsverschiebungen in der Auseinandersetzung mit Hegel: von der staatlichen Souveranitat hin zum Volkerrechtspositivismus, von der Moglichkeit der Staatengemeinschaft im Volkerrecht hin zur dialektischen Kritik an Hegels Grundlegung des Volkerrechts. An dieser Transformation der Perspektiven lassen sich die neuen Disziplingrenzen zwischen Rechtswissenschaft und Philosophie am Ausgang der Moderne ablesen.English Abstract: Hegel’s theory of international law is and was being received very ambivalent. The scope ranges from accusing Hegel of denying international law to further developing his approaches in current discussions on the background of entangled, global law. This text analyzes the essential points of Hegel’s theory of external state law (“auseres Staatsrecht”). It will be demonstrated how Hegel conceptualizes legal normativity of international law by reason. Due to Hegel’s agenda of balancing the particularity of actors in the international realm with the universality of the legal form, his theory seems attractive for current discourses on the theory of international law. It indicates how power and interest based approaches in international relations theory may be reconciled with the normative claim of international law. The second part portrays the ongoing debates about Hegel’s idea of international law since the 19th century. It specifies several shifts in perception of Hegel’s international law theory: from state sovereignty to positivism in international law, from conditions of an international society of states to a dialectic critique of Hegel’s premises. These transformations in perspective exceed the boundaries of the legal and philosophical disciplines." @default.
