- W3181728305 abstract "The question of when and how should a forum court exercise jurisdiction in civil matters having foreign elements has been a controversial one among judges, legal writers and students of conflict of laws. In Nigeria, the problem is more pronounced as the it operates a federal system of government with each component state having a distinct legislature and a court system. Hence, one can say that Nigeria is divided into 37 legal districts. The issue of inter-state choice of jurisdiction in Nigeria has become more prominent in the recent time as a result of cultural, social, and commercial exchanges between private individuals or corporations from different parts of the country. Nigeria inherited the English choice of jurisdiction rules by virtue of the reception laws. As such, the writ rule which emphasizes presence of the defendant in the forum court is the very foundation of a court’s assumption of jurisdiction. However, the Nigerian courts including the Supreme Court have clearly misconstrued the writ rule and the wisdom behind the long-arm statute (Sheriffs and Civil Processes Act) which makes provision for nationwide jurisdiction of courts. The courts have erroneously over the years based jurisdiction of courts on territorial bases of the cause of action. This paper seeks to point out this erroneous approach of the Nigerian courts with respect to choice of jurisdiction in matters having foreign elements and the challenges that have been occasioned by the said approach. Meaningful suggestions are offered to the courts at the end of the paper." @default.
