The major role the government play in this kind of relationship is to act as umpire that make rules that guides such relationship.The Industrial Relations system in Nigeria is very complex, this is so because government is the largest employer of workers in the country. As a result, labor and their union often lose faith most times in Government’s capacity to serve as a truly neutral umpire. This is evident in series of labor related issues that resulted in various industrial crisis across the country, most recently the planned nationwide strike on minimum wage that was aborted in the 11th hour.Employment related disputes also exist in the private sector, and there are several ways in which such disputes can be resolved. The National Industrial Court (NIC) is the highest court when it comes to employment related disputes, with Supreme Court of Nigeria retaining its Jurisdiction as the highest court in the country, whose position can override that of any other court in the country.Increase in lawsuits and heavy workload of the courts have however created a need for alternative, speedy, fair and organized settlement mechanisms. Hence, the introduction of Alternative Dispute Resolution (ADR). Mediation as a form of ADR in Nigeria is gradually becoming a viable option in resolving disputes within the shortest possible period when compared with litigation.Mediation is a form of Alternative Dispute Resolution in which the parties to a dispute meet with a mutually selected and neutral third-party who assists them in the negotiation of their differences with a view to reaching a mutually acceptable resolution thereof. The third-party is called a Mediator. The role of the Mediator Include:To listen to each party’s side, Help parties come to understand each other’s viewpoint regarding the controversy, Facilitate the negotiation of a voluntary resolution to the case, Assists the parties in creating an enabling environment for negotiation.The basic forms of mediation are:(i) Private (walk-in) mediation; involves assistance of an independent third-party services on a commercial basis.(ii) Court-Annexed Mediation; predetermined by the court.Mediation is a participatory process in which the mutual interest and the relationship of the parties are the focus. Parties are encouraged to find ways to address their present and future needs instead of focusing on who is right or wrong. It endeavors to create a “win-in-win” situation for parties. The most prominent mediation institutions in Nigeria are:(i) The Multi-door Court House (currently available in the FCT, Lagos, Kano, Ogun, Oyo and Edo states).(ii) The Lagos Court of Arbitration (LCA) - This is an independent center for the resolution of disputes, particularly commercial disputes.(iii) The Citizens Mediation Center (CMC) - An independent statutory corporation in Lagos state established by the Citizens Mediation Center Law 2007. It branches can be found in most Local Government Councils in the state.(iv) The Institute of Chartered Mediators and Conciliators - This is a body of professional mediators, which among others, aims at regulating the practice of mediation and conciliation in Nigeria. Trains and certifies new mediators through an accreditation and certification course and generally promotes the use of ADR for the resolution of disputes.To cap it, Mediation is usually less expensive than litigation with tendency of reaching resolutions faster. The desirability of parties being able to control the process makes it more resolution-oriented and underlines the participatory aspect that make actors prefer its voluntarism as against the imposition that arise from litigation. It is structured to restore relationship, and encourage creativity on part of actors. Little wonder the trend is emerging to avoid litigation in favor of mediation in Nigeria." @default.
