Za5577@hotmail.comالبريد الإلکتروني : ملخص : فإن هذه الدراسة تهدف إلي مناقشة واحدة من المعضلات التي تواجه المرأة، وتشکل إحدى مصادر المعاناة لها وهى قضية النفقة التي تواجه فيها المرأة أزمة مفاجئة حال امتناع الزوج أو المطلق عن الوفاء بالتزاماته المالية حيال الزوجة أو المطلقة وأبناءهما. وتظل مسألة النفقة الزوجية هي محل بحث للمتقدمين والمتأخرين والمعاصرين من العلماء، ليس لأن الحکم العام يختلف ولکن لتغير الزمان والعرف الذى يعتمد في بعض المسائل التي ترکت للعرف ، کتقدير النفقة مثلا ، فسترى العلماء في کل زمان يجعلون تقدير النفقة يناسب العرف العام ، وهو ما يقضى به القاضي في المحاکم الشرعية ، وينص عليه قانون الأحوال الشخصية . وقد تناولت هذه القضية بشکل مقتصدي، فأوضحت من خلال البحث المقاصد الشرعية المالية للزواج، من صداق ونفقة ونحوهما . تکمن أهمية البحث فيما يأتي إن موضوع النفقات الزوجية من المسائل الشائکة التي عادة ما تفضى إلى خلافات بين الزوجين، فأردت أن أذکر مقاصد هذه النفقات، وأفصل فيها الأمر تفصيلا يزيل اللبس والإشکال عند البعض ممن يجهلون مقاصد الشرع في هذا الباب ،فکان هذا البحث المتواضع . تمکين طلبة العلم من الإفادة من هذا الموضوع، بشکل سهل وميسور وتوفير الجهد والوقت عليهم .إغناء المکتبة الإسلامية بالأحکام الشرعية المتعلقة بهذا الموضوع ، کما أغنيت بأحکام غيره من الموضوعات الفقهية المختلفة . إبراز أحکام نفقة الزوجة وصداقها ؛ لأنها مرتبطة ارتباطا وثيقا بالحياة العامة للمسلم .إظهار نصاعة الأحکام الشرعية ووضوحها، والتي کثيرا ما يرميها أعداء الدين الإسلامي بالتناقض والاختلاف وعدم الائتلاف . الکلمات المفتاحية : المقاصد ، المالية ، الشرعية ، عقد ، النکاح .
