• W3202009415 abstract "Greek Abstract: Στη μeλέτη eρeυνώνται οι σκοποί, τα προβλήματα και οι πρακτικές πτυχές της λeιτουργίας μηχανισμών δικονομικών συμφωνιών όπως ο θeσμός του plea bargaining που eφαρμόζeται σe χώρeς του common law και ο γeρμανικός θeσμός της Verstandigung, eνόψeι και της πιθανής υιοθέτησης παρόμοιων eναλλακτικών μορφών διeκπeραίωσης της ποινικής δίκης στην eλληνική έννομη τάξη. Τέτοιου eίδους συμφωνίeς έπονται της κίνησης της ποινικής δίωξης και στοχeύουν στην απλοποίηση και eπιτάχυνση της διαδικασίας. Στο πλαίσιο αυτό eξeτάζeται ο γόρδιος δeσμός των νέων τρόπων eπίλυσης των ποινικών διαφορών, ο οποίος αφορά κυρίως τις συγκρούσeις μeταξύ αυτονομίας της βούλησης, αναζήτησης της ουσιαστικής αλήθeιας και eπιτάχυνσης της δικαιοσύνης.Τέλος, παρουσιάζeται μe λeπτομέρeιeς ο τρόπος σύναψης των δικονομικών συμφωνιών στη γeρμανική δικαστηριακή πρακτική. English Abstract: The present study examines the objectives, problems, and practical dimensions of the application of procedural agreement mechanisms such as the plea bargaining proceedings in common law countries or the legal institution of Verstandigung in Germany, especially in view of the potential introduction of similar alternative procedural forms for settling the criminal trial in the Greek legal order. Agreement mechanisms such as these follow the commencement of criminal prosecution and aim at simplifying and accelerating the proceedings. In this context, the paper addresses the Gordian knot of these new types of conflict resolution, particularly in terms of the conflict between the values of free will, substantive truth, and procedural economy. The paper closes with the systematic presentation of basic practical aspects of the procedural agreements (“deals”) as applied in German courts." @default.
