Penelitian hukum ini merupakan studi empiris normatif, dengan menggunakan studi kasus hukum normatif-empiris dalam bentuk produk perilaku hukum. Dalam hal ini subjek materi adalah; pelaksanaan Putusan Mahkamah Agung Nomor 4/PUU-X/2012 dalam penggunaan simbol negara sebagai bagian dari desain kaos bertema nasionalisme. Subyek penelitian ini menekankan penerapan hukum dan data faktual tentang peristiwa hukum kepada masyarakat untuk mencapai tujuan yang telah ditetapkan. Berdasarkan hasil penelitian yang dilakukan, dapat disimpulkan bahwa keputusan Mahkamah Konstitusi Nomor 4/PUU-X/2012 tidak memiliki pertentangan dengan UU No. 15 Tahun 2001 tentang Merek Dagang, namun memiliki pertentangan dengan UU No. 28 tahun 2014 tentang Hak Cipta membuat putusan tersebut tidak dapat dilaksanakan. Baik secara konstitusional maupun material, kedua hukum berwenang untuk mengatur penggunaan lambang Garuda Pancasila dalam konteks penggunaan Hak Kekayaan Intelektual. Hak Cipta lambang Garuda Pancasila dimiliki oleh Republik Indonesia, dan oleh serangkaian peraturan yang berlaku dalam konteks produk hak cipta, lambang negara dilarang untuk digunakan dalam desain kaos bertema nasionalisme karena telah melewati proses transformasi. Kendala yang terjadi dalam pelaksanaannya adalah masih banyaknya pihak yang tidak melihat perlindungan hak cipta terhadap lambang negara melalui UU Hak Cipta. This research aims to determine to which extent the Constitutional Court decision No. 4/PUU-X/2012 which makes Article 59 letter d and Article 67 letter c of Law No. 24 of 2009 concerning the Flag, Language, State Emblem, and National Anthem not legally binding can be implemented, it is mainly in the use of the emblem of Garuda Pancasila in nationalism themed t-shirt design. This legal research is a normative-empirical study, using a case study of normative-empirical law in the form of a product of legal behavior. In this case the subject matter is; the implementation of Supreme Court Decision No 4/PUU-X/2012 in the use of the state symbol as part of the design of t-shirts themed nationalism. The subject of the study emphasizes the implementation of positive law and factual data on the law events to the community in order to achieve the intended purpose. Based on the results of research conducted, the decision of the Constitutional Court Number 4 / PUU-X / 2012 has no contradiction with Law no. 15 of 2001 on Trademarks, but has a contradiction with Law no. 28 of 2014 on Copyrights make such decisions cannot be implemented. Either constitutionally or materially, both laws are authorized to regulate the use of the Garuda Pancasila emblem in the context of the use of Intellectual Property Rights. The copyright of the Garuda Pancasila emblem is owned by the Republic of Indonesia, and by a series of regulations applicable in the context of copyrighted products, the state symbol is prohibited to be used in a t-shirt design themed nationalism because it has passed the transformation process.
