Data yang dikumpulkan kemudian digunakan untuk menganalisis masalah yang dihadapi. Analisis difokuskan pada dua perspektif. Pertama, bagaimana undang-undang anti-perdagangan manusia Indonesia memberikan perlindungan hukum bagi orang asing yang menjadi korban perdagangan manusia di sektor perikanan. Kedua, tentang fasilitasi restitusi bagi orang asing yang menjadi korban perdagangan manusia di sektor perikanan. Berdasarkan analisis ini, kesimpulannya adalah bahwa orang asing yang menjadi korban perdagangan di sektor perikanan di Indonesia dilindungi oleh Undang-Undang nomor 21 tahun 2007. Ada beberapa indikasi yang ditafsirkan dari Undang-Undang nomor 21 tahun 2007 dan kewajiban dari Negara Pihak dalam Protokol Palermo. Penelitian hukum ini juga menyimpulkan bahwa Indonesia memang memfasilitasi Restitusi bagi orang asing yang menjadi korban perdagangan manusia dengan koordinasi dari semua penegak hukum dan Kedutaan Besar terkait. This legal research is aimed to analyze the legal protection for foreigners who became victims of trafficking in the fishery sector based on Law number 21 year 2007 and the facilitation of Restitution towards victims of trafficking in the perspective of criminal law. The method of this research is normative legal research that is supplement by the Interview with the related authority. In order to complement the data, the legal researcher chose to conduct an interview with Lembaga Perlindungan Saksi dan Korban (LPSK) which has the main task to provide protection for witness and victims. The data compiled was later used to analyze the issues at hand. The analysis focused on two perspectives. First, how the Indonesia anti-trafficking law provides legal protection for foreigners who became victims of human trafficking in the fishery sector. Second, regarding the facilitation of restitution for foreigners who became victims human trafficking in the fishery sector. Based on this analysis, the conclusions were that the foreigners who became victims of trafficking in the fishery sector in Indonesia are protected by the Law number 21 year 2007. There are some indications that is interpreted from the Law number 21 year 2007 and the obligation of the State Party in the Palermo Protocol.This legal research also concluded that Indonesia does facilitate Restitution for the foreigners that became victims of trafficking with the coordination from all the legal enforcer and the related Embassy." @default.
