- W3206370636 abstract "AbstractLarge-scale lockdowns imposed in response to the Covid-19 pandemic may amount to a breach of the right to work in its quantitative component: the right of everyone to have at least the opportunity to find a job. Given the current diminution of the job market with the advent of artificial intelligence, and taking into account the systemic risks to employment in the global economy, the right to work’s “minimum core”—a concept enshrined in the social, cultural, and economic rights doctrine—could be affected by policies leading to mass unemployment. Even if lockdowns do not affect the core of the right to work, to be acceptable, they must be the least restrictive policies required by the circumstances, which has to be decided by a careful balancing of the alternatives. This article argues that countries that chose to “go early and go hard” might have circumvented the balancing requirement. AcknowledgmentsThe authors are grateful to the two anonymous reviewers for their comments of exceptional depth and accuracy.Notes1 Socioeconomic rights are, however, justiciable in the countries that enshrine them in their Constitutions, such as Germany or South Africa (see Tridimas and Gentile, Citation2019).2 See, for example, International Labour Organization, Constitution of the International Labour Organisation, April 1, 1919; Convention for the Protection of Human Rights and Fundamental Freedoms, opened for signature on November 4, 1950, 213 UNTS 221 (entered into force on September 3, 1953); Convention on the Elimination of All Forms of Discrimination against Women, opened for signature on December 18, 1979, 1249 UNTS 13 (entered into force on September 3, 1981); ILO, Convention Concerning Employment Policy, July 9, 1964, C122; European Union, Charter of Fundamental Rights of the European Union, October 26, Citation2012, Citation2012/C 326/02.3 See, for instance, Committee on Economic, Social, and Cultural Rights, General Comment No. 3 (1990), “The Nature of States Parties Obligations” (Article 2(1) of the International Covenant on Economic, Social, and Cultural Rights), UN Economic and Social Council Office of Records, fifth session, UN Doc E/1991/23 (December 14, 1990) paragraph 1; Committee on Economic, Social, and Cultural Rights, General Comment No. 18 (2006), “The Right to Work” (Article 6 of the International Covenant on Economic, Social, and Cultural Rights), UN ESCOR, 35th session, UN Doc E/C.12/GC/18 (November 24, 2005) para 20.4 See, for example, Committee on Economic, Social, and Cultural Rights, General Comment No. 4 (1991), “The Right to Adequate Housing” (Article 11(1) of the International Covenant on Economic, Social, and Cultural Rights), UN ESCOR, sixth session, UN Doc E/1992/23 (December 13, 1991) paragraph 11; Committee on Economic, Social, and Cultural Rights, General Comment No. 12 (1999), “The Right to Adequate Food” (Article 11 of the International Covenant on Economic, Social, and Cultural Rights), UN ESCOR, 20th session, E/C.12/1999/5 (May 12, 1999) paragraph 19.5 Sentencia 11/1981, S.T.C., April 25, 1981 (B.O.E., No. 99) (Spain).
