- W3209161259 abstract "Physician assistants (PAs) are widely used in emergency departments (EDs) across the country. To our knowledge, there is no published literature that focuses on emergency medicine PA malpractice trends. The objective of this study is to review ED medical malpractice claims involving PAs. Data was utilized from The Doctors Company (TDC), the largest physician-owned malpractice insurer in the nation. A retrospective study was performed on closed malpractice claims from TDC database, of more than 23, 000 fully coded claims, between 2010 and 2019. The data used in this study was from the Comprehensive Risk Intelligence Tool created by CRICO Strategies (Risk Management Foundation of the Harvard Medical Institutions). Claims were selected if PAs were identified as either the primary or other party responsible for the care of the patient at the time of the alleged patient injury and if the clinical location was the emergency department. Various characteristics were identified and analyzed for any associated trends. Between 2010 and 2019, 62 claims were identified involving PAs compared to 906 involving physicians (PHY) with no PA involvement. 55% of PA claims were female and 79% were between the ages of 18-64 years old. The most common injuries were death (31%), “need for surgery or procedure due to patient harm” (21%) and “condition made worse by treatment or procedure” (18%). The most common admitting diagnoses were abdominal pain, open wound (finger), dizziness and headache. The most common final diagnoses were pulmonary embolism, cerebral vascular accident, epidural hematoma, nervous system complications and puncture/laceration during procedure. Over 70% of cases were diagnosis related followed by improper management or treatment (8%). Greater than 80% of factors that contribute to patient harm were patient assessment issues. Nearly 40% of factors involved communication among providers and failure or delay in obtaining a consult or referral. 35% of PA claims resulted in indemnity (compensation) compared to 31% PHY. The median indemnity paid on behalf of PAs was $114,350 and the median defense expense was $109,835 compared to PHY median indemnity of $220,000 and PHY median defense expense of $90,038. Over 60% of PA claims/suits were dropped/dismissed. In this database, PA claims were lower than PHY between 2010 and 2019. PAs and PHY have similar indemnity, although the median PA indemnity is just over half the amount of PHY. Most claims against PAs were dropped/dismissed. PA malpractice claims in emergency medicine are usually diagnosis related. These findings suggest that future PA education or quality improvement initiatives focus on the above identified factors." @default.
