The issue in the case is whether an administrator who requested an accreditation review of his institution can succeed in a defamation suit against a member of the accreditation team who made some negative, but rather innocu ous, comments about the institution dur ing the accreditation process. The reason this case is so significant is that a federal district court jury in Delaware recently awarded a $50,000 judgment in just such a case.1 The case is now on appeal to the U.S. Court of Appeals, Second Cir cuit. The Association of American Law Schools, the American Council on Educa tion, and the Council on Postsecondary Accreditation have filed an amid curiae brief in an effort to have the jury verdict reversed. To understand the implications of the case, it is necessary to review the facts. Alfred Avins founded the Delaware Law School in 1971. At the time, the law school had no affiliation with any estab lished college or university and relied almost entirely upon student tuition for revenue. In order for its graduates to take the bar examination in Delaware and sur rounding states, it was necessary for the school to secure accreditation from the American Bar Association (ABA). Ac cordingly, Avins, who was the school's first dean, requested that the ABA con duct a review of the school to determine whether it warranted accreditation. A series of ABA accreditation visits began in January 1974. James P. White, at that time an ABA consultant on legal education, was a member of the accredita tion team. During the following two years, White made four statements for which Avins later sued him for defama tion. The first statement was in the in spection report filed by the accreditation team following its first visit to the school. At the end of an 11-page, single-spaced re port was the following statement: The most important deficiency is an in tangible one: There is an academic en nui that pervades the institution.
