But this may soon change. The Office of the Inspector General (OIG) in the Department of Health and Human Services has warned the drug industry that many of its marketing practices may violate federal fraud and laws. A new fifty-six-page compliance guide issued on 28 April says that federal anti-kickback laws prohibit drug manufacturers from making payments to doctors, drug purchasers, and others with the intention of encouraging them to prescribe the manufacturer's drugs. Under federal law, it is a felony for a drug company to give something of value to a person to induce them to generate business reimbursable under Medicare or Medicaid. Practices with a high potential for fraud and abuse include gifts, entertainment, and personal services compensation arrangements. When the OIG published a draft of the compliance guide in October, it was swiftly denounced by industry representatives, physicians, and professional medical societies. According to the New York Times, industry representatives ac knowledged that they routinely make payments to insurance plans to increase the use of their products and to reward doctors and pharmacists for switching patients to their drugs. But they claimed these payments were well-established commercial practices. The OIG was apparently unconvinced. Its compliance guide specifically warns against giving doctors fees to listen to business presentations, compensating them for signing ghost-written articles or delivering ghostwritten speeches, and providing them with travel, meals, or entertainment in association with informational presentations. Entrepreneurial bioethicists may also want to read the compliance guide carefully. It states that its warnings apply not merely to payments to physicians and insurers, but to anyone in a position to generate federal health care business, including (but not limited to) allied health professionals, hospital formulary committee members, and pharmacists. Many bioethicists and bioethics centers actively seek out funding from the drug industry, either for personal consulting arrangements or for institutional support.
