- W36311571 abstract "Regulatory classification, as applied, would mean that development and other land uses affecting wetlands with low functional value would likely be less stringently regulated than land use activities affecting wetlands of high value. Classification may also provide a means for identifying appropriate kinds and levels of mitigation for unavoidable impacts to wetland functions. Absent regulatory classification, there is a presumption that all wetlands are of equal significance with respect to functional value, and that no distinctions are necessary in the level of regulation or in designating mitigation requirements. There is little disagreement that wetlands serve several important functions, such as water quality improvement, flood control, groundwater recharge or discharge, and fish and wildlife habitat. These, and many other values, have been recognized as a basis for state and federal legislation governing activities in or adjacent to wetlands. The validity of a wetland regulatory classification, however, particularly a federal classification system, hinges on other critical questions, including whether all wetland values can be identified, whether the values once identified can be weighted relative to other values, and whether federal or state classification systems can accurately assess wetland values which may need to be evaluated in relation to sitespecific factors. Even if there is uncertainty in determining wetland value, classification systems may encourage state and federal agencies to prioritize regulatory resources, direct development to or away from certain wetlands, and may correct, as EPA Administrator William Reilly recently stated, the current feeling that wetlands policy discourages growth of any sort. Existing state laws and proposed federal laws attempt, in varying degrees, to address these important wetland classification issues." @default.
