- W4200014503 abstract "One of the jurisprudential lines clearly drawn by the IACtHR refers to the citizens’ political rights, either through participation in political life, or having access to the public functions of their country, as required under Art. 23 of the ACHR. This contribution aims to analyse these cases to determine whether the political trend in the case of Guatemala is towards the protection of defenders, journalists and political leaders belonging to indigenous communities. In this regard, the authors will assess whether the context of violence experienced by the State during the period from the eighties to the nineties (in December 1996, the Peace Agreement was signed) led to the lack of guarantees for political leaders or journalists to freely express their ideology and their free participation in elections or public functions. For this purpose, the three cases in which the IACtHR established Guatemala’s international responsibility for violations of political rights will be analysed, emphasising the comprehensive set of reparations ordered by the IACtHR. Finally, the compliance monitoring results will be systematised in terms of what is ordered by the IACtHR and the response – or not – of the State." @default.
