Particular attention is paid to the first stage of inheritance, as it is the starting point for determining thefurther order of inheritance, distribution of inheritance, and so on. A comparative analysis of the subjects, which by thelaws of the above states are referred to the first stage of inheritance, based on which common and different featuresof the legislators’ view of the need to include relevant persons in the list of primary heirs, has been conducted.A detailed study of the provisions of the legislation of Ukraine, Lithuania and Poland within the establishment of thefirst stage of inheritance by law was made. The motives of the legislators of the compared states to refer the relevantsubjects to the first stage of inheritance by law in terms of understanding the permissible will of the testator werestudied. The shortcomings of the subject composition of the first stage of legal inheritance in Ukraine, Lithuania and Poland have been revealed. The vectors of improvement of the subject composition of the first stage of inheritanceaccording to the law under the legislation of Ukraine are determined. The ways of improvement of settlement ofinheritance relations in Ukraine within the limits of inheritance by heirs of the first turn taking into account themaximum maintenance of their hereditary rights and interests are offered. It is determined that a distinctive featureof the subject composition of the first stage of inheritance under the laws of Ukraine, Lithuania and Poland is alsodifferent attitudes to the possibility of inheritance by the parents of the deceased. The Ukrainian legislator refers theparents of the testator, who are alive at the time of his inheritance, to the first priority of inheritance, equating them ininheritance rights to the children and spouses of the testator. Instead, the Civil Code of Lithuania and the Civil Codeof Poland give the testator’s parents, who are alive at the time of the latter’s death, the right to inherit only in theabsence of the previous (first) line of heirs. The author notes that Ukraine, Lithuania and Poland have a similar visionof the subject composition of the first stage of inheritance, including those who are closest to the testator in termsof blood and social kinship. At the same time, it should be noted that such a vision cannot be considered perfect, asboth Ukraine, Lithuania and Poland have some minor omissions in the regulation of inheritance relations within thecall to inherit the first priority of heirs at law." @default.
