- W4223988941 abstract "The emergence of criminal proceedings on the basis of agreements is a novelty both for the criminal procedural law of Ukraine and for the procedural activities of the pre-trial investigation bodies and the judicial system. The given innovation was previously unknown to the Ukrainian legal system, since it was taken from the English-American experience in order to save time and improve criminal justice. The purpose of conducting criminal proceedings on the basis of agreements as a special procedure for criminal proceedings is, first of all, to resolve the existing criminal law conflict between parties to it, to simplify and shorten the general procedure of criminal proceedings, to ensure procedural economy, to reduce the load on the courts, to provide self-sufficiency to the parties to the agreement in solving the question of imposing punishment stipulated by them with relief of serving on probation. Criminal proceedings on the basis of agreements are a manifestation of the differentiation of the criminal procedural form, which is based on substantive criteria that provide for the establishment of the content of contractual legal relationship, and criminal procedural criteria that determine the form and procedure for achieving reciprocal concession between the parties to agreements on reconciliation or admission of guilt in criminal proceedings. However, the science of criminal procedural law and practice still have a large number of contradictory approaches, inconsistency in legal positions and a different vision of some aspects of the functioning of such an institution left. In particular, contradictions arise in determining the features of criminal procedural proof on the basis of agreements being the subject of this scientific study. The main approach to the issue’s review in the given article is to carry out a critical analysis of the norms of the current legislation governing the features of criminal procedural proof during proceedings on the basis of agreements. The publication analyzes the normative regulation of criminal proceedings on the basis of agreements, comments on a number of norms of the Code of Criminal Procedure, which fix the features of criminal procedural proof during proceedings on the basis of agreements, and offers the approaches to correct their defects. The materials of the article are of both theoretical and practical value. They can be used for further scientific research of the features of criminal procedural proof during proceedings on the basis of agreements, as well as for a proper understanding and implementation of law enforcement procedural activities. " @default.
