- W4229377598 abstract "This article highlighted the existence of a non-uniform judicial practice regarding the solution pronounced by the courts when the limitation period for criminal prosecution has expired. In some cases, the Supreme Court of Justice has ordered the termination of criminal proceedings. On the contrary, in other cases, the Supreme Court considered it appropriate to pronounce a sentence of conviction, but without the application of a criminal penalty. In this regard, we have demonstrated that it is possible to order the termination of the criminal proceedings, due to the expiration of the limitation period in the event that the defendant does not request the examination of the merits of the case. At the same time, if the defendant requests an examination of the case and claims that he is innocent, then the court must investigate the evidence and draw a proper conclusion in this regard. Thus, if the court finds that the person is innocent, he must issue an acquittal. Correlatively, in the event that the court finds the person guilty, then he will have to specify this in his motivation, but not in the operative part of the decision (sentence / decision).
