The town annexed their property containing the mobile home park in July 1978. Prior to annexation, and from the date of annexation until 1983, the Rickses provided water and sewer services to the mobile home park by private wells and septic tanks constructed at their own expense. In 1983, the Rickses tapped into the municipal water service but not the sewer system. They paid for sewer services that were available, but not received, pursuant to the city ordinance requiring a minimum charge. In this suit, the Rickses challenged the city ordinance.
