This piecemeal approach consists of a mix of limited federal regulation with a loose focus on “diversity” reporting that allows corporations to adopt their own definitions of diversity, state-level innovation led by a handful of states only, and scattered efforts by individual businesses to self-regulate, which comes mostly from investor pressure. The implementation of this policy patchwork in a context of a highly federalized system that has been historically hostile to business regulation has quickly shown its limits. There is no consistent increase in women’s presence on corporate boards across the corporate world.
