- W4283331650 abstract "This chapter assesses the extent to which the Berne Convention does require or permit extrapolation of a supranational set of choice of law rules. In the absence of a Berne rule on legislative competence (jurisdiction to prescribe), it addresses general principles of private international law to inquire whether a <italic>de facto</italic> or customary set of choice of law rules applied by national courts exists or is in prospect. First, however, the chapter takes up the predicate question of judicial competence (jurisdiction to adjudicate): when does a national court have power to hear claims alleging infringement of copyright in other countries? This inquiry is of considerable practical importance for two reasons. First, effective enforcement (or defence) of copyright claims may turn on the ability to resolve a broad range of territorial infringements in a single action. Second, and relatedly, a court asked to enforce a foreign judgment usually will ascertain whether the rendering court exercised jurisdiction over the claim and over parties under rules consistent with fundamental fairness. Third, in the absence of a supranational rule on legislative jurisdiction, the forum will apply its own choice of law rules. If different forums have different choice of law rules, the determination of judicial jurisdiction may affect, or even dispose of, the outcome in the case." @default.
