• W4284681146 abstract "The article, referring to the current constitutional and municipal legislation, as well as the work of scholars, argues that the further improvement of the legal regulation of the institution of representative democracy in Ukraine should not take into account the self-organization of the population. It is demonstrated that at the present stage the bodies of self-organization of the population have a private rather than a public nature, and therefore are not representative public authorities (public-representative bodies). For example, it is unlikely that a public authority (regardless of whether it is representative) can be formed in such a way as a body of self-organization of the population and so on. Normative definitions of the concept of bodies of self-organization of the population are analyzed. It has been shown that they lack a clear reflection of the essence of these bodies. It is emphasized that not all normative definitions are clear, concise, and fully characterize the phenomena, etc., which they define. Regulatory definitions may become obsolete. Normative definitions are not without flaws, and quite often these shortcomings are significant – sometimes these shortcomings are significant, sometimes formal. It is enough to turn to any fundamental work of a specialist in a particular field of law – and it is unlikely that there will be no criticism of one or more normative definitions. It is emphasized that quite often specialists operate with normative definitions as universal. However, hardly any normative definition can claim universality. It was emphasized that an approach would be more fruitful, according to which the authors of draft laws (and other legal acts) would be more committed to the unity of the thesaurus and would use references to definitions already formulated in law.
