The Council for the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS Council) announces that the European Union (EU) requested China to provide information under Article 63.3 of the TRIPS Agreement on 6 July 2021.1 The request demanded information on multiple judicial cases related to standard essential patents (SEP) in China. This course of action by the EU was for the purpose of ensuring transparency in the protection of intellectual property rights under the TRIPS Agreement. The decisions in question relate to four Chinese SEP cases—including the Conversant v Huawei case (Supreme People’s Court, 2020),2 in which an anti-suit injunction was issued by the court. The EU requested that detailed information on those SEP cases be provided through the Chinese government’s court case website3 or other means. This article will first outline the Chinese government’s overly ‘solid’ interpretation of Article 63.3 TRIPS and will then examine its possible teleological interpretation, which considers the principles and objectives of the treaty, based on the rules of the Vienna Convention on the Law of Treaties and international customary law." @default.
