Исследуется история нормативно-правового регулирования договора буксировки с целью фиксации момента появления данного договора в качестве самостоятельного. В качестве отправной точки для проведения исследования автором используется Свод законов Российской империи. Приводятся мнения дореволюционных цивилистов по рассматриваемому вопросу. Рас-сматривая советский период развития отечественного права, автор указывает на Кодекс торгового мореплавания СССР, в котором, по его мнению, договор буксировки впервые получает своё нор-мативное регулирование. Автор выявляет имевшиеся в 50–70-х годах XX в. в отечественной юри-дической точки зрения по вопросу разграничения договора буксировки и схожих по содержанию договорных обязательств. В итоге делается вывод о том, что в действующем законодательстве до-говор буксировки сохранен как самостоятельный гражданско-правовой договор, и проведено бо-лее четкое разграничение договора буксировки и договора перевозки грузов, закреплены обязан-ности по участию владельца буксируемого плавучего объекта (отправителя) в процессе буксиров-ки. В целом курс законодателя на разграничение договоров буксировки и смежных договорных обязательств будет сохранён и в ближайшей исторической перспективе. In this article, the author identifies the correlation of the towing contract with other contractual obliga-tions. The history of the legal regulation of the towing contract is studied in order to fix the moment of the appearance of this contract as an independent one. The author uses the Code of Laws of the Russian Em-pire as a starting point for conducting the research. The opinions of pre-revolutionary civilists on the issue under consideration are given. Considering the Soviet period of the development of domestic law, the au-thor points to the Code of Merchant Shipping of the USSR, in which, in his opinion, the towing con-tract for the first time receives its regulatory regulation. The author identifies the existing in the 1950–70s in the domestic legal literature a point of view on the issue of distinguishing the towing contract from simi-lar contractual obligations. As a result, it is concluded that in the current legislation, the towing contract is preserved as an independent civil contract, and a clearer separation of the towing contract from the car-go transportation contract is carried out, the obligations for the participation of the owner of the towed float-ing object (sender) in the towing process are fixed. In general – the course of the legislator on the differ-entiation of towing contracts and related contractual obligations will be preserved in the near historical perspective." @default.
