Отличительной чертой современного законодательства в этой сфере является назначение обязательного лечения к больным наркоманией: осужденным условно (ч. 5 ст. 73 УК РФ); осужденным к основным наказаниям в виде штрафа, лишения прав занимать определенные должности или заниматься определенной деятельностью, обязательных работ, исправительных работ, ограничения свободы (ч. 1 ст. 72 УК РФ); освобожденным условно-досрочно от отбывания наказания (ч. 2 ст. 79 УК РФ). Данное лечение может быть применено решением медицинской комиссии к осужденным к принудительным работам, аресту, лишению свободы (ч. 3 ст. 18 УИК РФ). В статье отмечается недостаточность изучения противодействия преступлениям лиц в пенитенциарный и постпенитенциарный периоды, мерам, принимаемых в этот период. В этой части им предлагается, в частности, повысить роль административного надзора за лицами, освобожденными из мест лишения свободы, не прошедшие курс обязательного лечения. The description of criminal legal and penal measures to combat crimes committed by persons with drug addiction is given, while emphasis is placed on preventing the recurrence of crimes on their part. On the basis of an analysis of theoretical sources, criminal law and penal enforcement law, a retrospective of the question presents the author's view on the implementation of these measures. Existing legislation, unlike legislation in the Soviet and early years of the post-Soviet period, did not provide for the use of coercive medical measures. A distinctive feature of modern legislation in this area is the prescription of compulsory treatment for drug addicts: convicts conditionally (part 5 of article 73 of the Criminal Code of the Russian Federation); sentenced to the main penalties in the form of a fine, deprivation of the right to hold certain posts or engage in certain activities, compulsory labor, correctional labor, restriction of liberty (part 1 of article 72 of the Criminal Code of the Russian Federation); released on parole from serving a sentence (part 2 of article 79 of the Criminal Code of the Russian Federation). This treatment can be applied by decision of the medical committee to convicts of forced labor, arrest, imprisonment (part 3 of article 18 of the Penal Code of the Russian Federation). The article notes the insufficient study of the measures taken to combat the crimes of persons during the penitentiary and post-penitentiary periods.
