Автор приходит к выводу, что отдельные вопросы, касающиеся выдачи лекарственных препаратов осужденным, еще нуждаются в регламентации или уточнении на уровне закона. Автор предлагает рассматривать процесс оказания медицинской помощи осужденным с точки зрения типичных ситуаций, встречающихся в практической деятельности сотрудников уголовно-исполнительной системы. В связи с этим автор статьи считает возможным, используя универсальную модель правоотношения, включающую в себя объект, субъектов, их права и обязанности (содержание), распространить ее на уголовно-исполнительные правоотношения, связанные с оказанием медицинской помощи осужденным. Такой подход, несмотря на известную долю его условности, позволяет выделить два блока типичных ситуаций, сопряженных с конвоированием больных и здоровых осужденных, которым понадобилась экстренная или неотложная помощь. При этом автор обращает внимание на определенный набор критериев, позволяющих типизировать рассмотренные ситуации: 1) четкий круг осужденных лиц, подлежащих перемещению; 2) должностных лиц, ответственных за ее оказание; 3) общие и специальные правила конвоирования больных осужденных; 4) документацию, необходимую для организации конвоирования больных осужденных. Методологическую основу исследования составляет совокупность общенаучных и частнонаучных методов познания (анализ, синтез, сравнительно-правовой метод). The article highlights the problem associated with the provision of medical care to convicts in the process of their escorting. The author comes to the conclusion that certain issues concerning the issuance of medicines to convicts still need to be regulated or clarified at the level of the law. The author proposes to consider the process of providing medical care to convicts from the point of view of typical situations encountered in the practical activities of employees of the penitentiary system. In this regard, the author of the article considers it possible, using a universal model of legal relations, including the object, subjects, their rights and obligations (content), to extend to criminal-executive legal relations related to the provision of medical care to convicts. This approach, despite a certain proportion of its conditional nature, allows us to distinguish two blocks of typical situations involving the escorting of sick and healthy convicts who needed emergency or emergency care. At the same time, the author draws attention to a certain set of criteria that allow us to typify the considered situations: 1) a clear circle of convicted persons to be moved; 2) officials responsible for its provision; 3) general and special rules for the escort of sick convicts; 4) documentation necessary for the organization of the escort of sick convicts. The methodological basis of the research consists primarily of such general scientific and private scientific methods of cognition as analysis, synthesis, and the comparative legal method." @default.
