Несмотря на общий карательный характер содержания, заложенный в основу ряда документов (Соборное уложение 1649 г., Новоуказные статьи «О татебных, разбойных и убийственных делах» 1669 г., Артикул Воинский 1715 г. и др.), выявляются определенные тенденции зарождения гуманистических начал. Согласно мнению автора, происходило поступательное изменение процесса исполнения наказания в сторону его смягчения и облегчения участи осужденного. Делается вывод о том, что тюремное заключение становится местом длительного отбытия наказания, т. е. карой, а не предварительным заключением перед казнью. Также отмечается, что с появлением в пенитенциарном законодательстве новых видов наказания (ссылка, каторга, работные и смирительные дома и др.) у государства возникла возможность использовать труд заключенных в качестве дешевой рабочей силы. В статье подчеркивается, что утверждение абсолютизма и кардинальное реформирование отечественного государственного устройства, проводимое Петром I, Екатериной II и другими правителями, потребовало создания и принятия ряда нормативных правовых актов, давших толчок для унификации и кодификации пенитенциарного законодательства. Автор приходит к заключению, что несмотря на усиление карательной политики наказание становится дифференцированным («по винам»), т. е. назначалось в зависимости от вида, характера и тяжести совершенного преступления. Цели наказания из карательно-устрашительного со временем приобретали более превентивное содержание. The article examines the stages of development of penitentiary legislation of the XVII-XVIII centuries by analyzing the most famous normative legal acts of that time. Despite the general punitive nature of the content laid down in the basis of these documents, the author identifies certain patterns of the origin of humanistic principles, the nature of which is contained in the evolution of social development in the Russian state. According to the author's conclusion, there was a gradual change in the process of execution of the sentence in the direction of mitigation and relief of the fate of the convicted person. It is concluded that imprisonment becomes a place of long-term serving of the sentence, that is, a punishment, and not a pre-trial detention before execution. The author also notes that with the introduction of new types of punishment in the penitentiary legislation (exile, hard labor, workhouses and straitjackets, etc.), the state has the opportunity to use cheap labor and the labor of prisoners. The article emphasizes that the establishment of absolutism and the radical reform of the domestic state system, carried out by Peter I, Catherine II and other rulers of Russia, required the creation and adoption of a number of normative legal acts that gave an impetus to the unification and codification of penitentiary legislation. It is concluded that, despite the strengthening of the punitive policy, the punishment begins to be differentiated (by fault), that is, depending on the type, nature and severity of the crime committed. And the goals of punishment, from punitive and intimidating, gradually become more preventive." @default.
