Авторы акцентируют внимание на том, что при осуществлении закупок учреждения и предприятия уголовно-исполнительной системы в случаях, установленных законом, имеют различное правовое регулирование. По мнению авторов, нормы, регулирующие указанные правоотношения требуют дополнительной проработки вплоть до внесения изменений в федеральное законодательство. The article highlights the issues of legal regulation of public procurement for state needs of the penal system, concludes that the norms of special legislation on the contract system, which by its legal nature is an institution of civil law, are prioritized before the Civil Code of the Russian Federation. Particular attention is drawn to the lack of content of the subject of legal regulation specified in the Federal Law of 05.04.2013 No. 44 «On the contract system in the procurement of goods, works, services to meet state and municipal needs», limited to the triad of legal relations: the supply of goods , the performance of work, the provision of services, in fact, regulating the entire array of civil contracts concluded by the state customer, including institutions of the penal system in the course of their activities. The authors focus on the fact that when making purchases, institutions and enterprises of the penal system in cases established by law have different legal regulation. According to the authors, the norms governing these legal relations require additional elaboration up to the introduction of amendments to federal legislation." @default.
