Разбирается вопрос о процессуальной самостоятельности следователя и вмешательстве руководителя в ход расследования уголовного дела. Дана характеристика особенностей полномочий руководителя следственного органа при расследовании уголовного дела следователем, проанализирован правовой статус руководителя следственного органа, а также определен порядок и основания процессуального контроля за деятельностью следователя на данной стадии, основания вмешательства руководителя следственного органа в ход расследования уголовного дела. Проанализированы полномочия руководителя следственного органа после реформы следственных органов России, в результате которой создан Следственный комитет Российской Федерации, после чего процессуальные полномочия руководителя следственного органа стали намного шире, чем ранее возлагавшиеся на прокуратуру. В процессе исследования был сделан вывод о том, что полномочия руководителя следственного органа довольно обширны, однако противоречивы с учетом определенной уголовно-процессуальным законодательством процессуальной самостоятельности следователя, поскольку в современной модели уголовного судопроизводства задача обеспечения процессуальной независимости следователя уже не является основной задачей и доминирующее положение на стадии предварительного следствия заняли отношения власти и подчинения, которые позволяют руководителю следственного органа вмешиваться в процессуальную деятельность подчиненных сотрудников. The purpose of the study is to consider and determine the terms of authority of the head of the investigative body and the problems arising during the implementation of departmental procedural control, the interaction of the head with the investigator during the investigation of a criminal case. The article examines the issue of the procedural independence of the investigator and the intervention of the head in the course of the investigation of a criminal case. The characteristics of the features of the powers of the head of the investigative body during the investigation of a criminal case by the investigator are given, the legal status of the head of the investigative body is analyzed, and the procedure and grounds for procedural control over the activities of the investigator at this stage, the grounds for the intervention of the head of the investigative body in the course of the investigation of a criminal case are determined. The author analyzes the powers of the head of the investigative body after the reform of the investigative bodies of Russia, as a result of which the Investigative Committee of the Russian Federation was created, after which the procedural powers of the head of the investigative body became much broader than previously assigned to the prosecutor's office. In the course of the study, it was concluded that the powers of the head of the investigative body are quite extensive, but contradictory, taking into account the procedural independence of the investigator defined by the criminal procedure legislation, since in the modern model of criminal proceedings, the task of ensuring the procedural independence of the investigator is no longer the main task and the dominant position at the stage of preliminary investigation was occupied by the relations of power and subordination, which allow the head of the investigative body to interfere in the procedural activities of subordinate employees." @default.
