Нормы об уголовной ответственности юридических лиц, предусмотренные этими кодексами, вступают в силу с 1 января 2023 г. Рассматриваются обстоятельства включения в уголовный и уголовно-процессуальный законы норм об ответственности юридических лиц. Отмечается, что новое армянское уголовное законодательство признает юридических лиц субъектами уголовной ответственности, заключающейся в применении к ним мер уголовно-правового воздействия. Указываются основания уголовной ответственности юридических лиц, приводятся и раскрываются виды мер уголовно-правового воздействия, применяемых к юридическим лицам: штраф, временное приостановление права занятия определенным видом деятельности, принудительная ликвидация, запрет деятельности на территории Армении. Кроме того, отмечается, что к юридическому лицу может быть применена конфискация имущества. По действующему законодательству Армении юридические лица участвуют в уголовно-процессуальных отношениях только в качестве гражданских истцов, гражданских ответчиков, а также лиц, которые могут участвовать в избрании меры пресечения в виде поручительства организации. С 1 января 2023 г. они становятся и участниками уголовно-процессуальных отношений в качестве лиц, привлекаемых к уголовной ответственности. В статье рассматриваются вступающие в силу с указанной даты уголовно-процессуальные нормы, определяющие общие условия производства и порядок возбуждения уголовного дела в отношении юридического лица; обстоятельства, исключающие уголовное преследование юридического лица; права и обязанности юридического лица, в отношении которого ведется уголовное судопроизводство; подсудность дел в отношении юридических лиц. Делается вывод, что принятие новых Уголовного и Уголовно-процессуального кодексов Армении - первый шаг на пути включения в правовую систему Армении института уголовной ответственности юридических лиц. This publication is an attempt to comprehend the novels of the Armenian criminal and criminal procedure legislation on the criminal liability of legal entities established in the Republic of Armenia after the adoption of the new Criminal and Criminal Procedure Codes in 2021. The norms on the criminal liability of legal entities provided for by these codes shall come into force on January 1, 2023. The circumstances of the inclusion in the criminal and criminal procedure laws of the norms on the liability of legal entities are considered. It is noted that the new Armenian criminal legislation recognizes legal entities as subjects of criminal liability, which consists in the application of measures of criminal law to them. The grounds for the criminal liability of legal entities are indicated, the types of measures of criminal legal action applied to legal entities are given and disclosed: fine, temporary suspension of the right to engage in a certain type of activity, compulsory liquidation, prohibition of activities on the territory of Armenia. In addition, it is noted that the confiscation of property can be applied to a legal entity. According to the current legislation of Armenia, legal entities participate in criminal procedural relations only as civil plaintiffs, civil defendants, as well as persons who can participate in the choosing a measure of restraint in the form of an organization's surety. From January 1, 2023, they also become participants in criminal procedural relations as persons brought to criminal responsibility. The article discusses the criminal procedural norms that have come into force from this time, which determine the general conditions of production and the procedure for initiating a criminal case against a legal entity; circumstances precluding criminal prosecution of a legal entity; the rights and obligations of a legal entity in respect of which criminal proceedings are being conducted; jurisdiction of cases against legal entities. It is concluded that the adoption of the new Criminal and Criminal Procedure Codes of Armenia is the first step towards the inclusion of the institution of criminal liability of legal entities in the legal system of Armenia." @default.
