Статья посвящена исследованию сущностных и квалификационных административно-правовых аспектов противоправного поведения террористической направленности. Исследование осуществлено с применением традиционных методов научного познания - диалектического метода, анализа, синтеза, индукции, дедукции, а также формально-юридического и сравнительно-правового методов. В статье рассмотрены различные подходы к определению сущностного наполнения дефиниций «противоправное поведение» и «терроризм», обоснована позиция о необходимости достижения должной результативности мер, направленных на противодействие противоправному поведению террористической направленности в обществе. Проведено интегральное исследование противоправного поведения с учетом существующих негативных и позитивных составляющих, поскольку указанный феномен выступает в качестве одного из основополагающих факторов, предопределяющих общественный прогресс. Особое внимание в статье уделено наиболее результативному способу осуществления направленного действия государства по противодействию противоправному поведению террористической направленности - административно-правовому, который предопределяет выстраивание системы государственного управления, чтобы обеспечить возможность эффективным образом в целом и на различных уровнях формирующих ее подсистем действовать целесообразно указанной угрозе. Резюмируется необходимость осуществления целенаправленной деятельности по организации процесса совершенствования административно-правовых средств противодействия терроризму комплексно в правовой и организационной сферах. Обосновывается идея о необходимости достижения должного уровня согласованности и эффективности деятельности государств в отношении понимания правовой природы исследуемых деяний, поскольку каждый конкретный факт противоправного поведения исследуемой формы носит не только внутригосударственный, но и международный характер. The study of such a social and legal phenomenon as illegal behavior has been significant throughout the entire period of human existence, regardless of changes in the types of state power and the level of formation of social relations. The article is devoted to the study of the essential and qualifying administrative and legal aspects of unlawful behavior of a terrorist nature. The study was carried out using traditional methods of scientific knowledge - the dialectical method, analysis, synthesis, induction, deduction, as well as formal legal and comparative legal methods. The article discusses various approaches to determining the essential content of the definitions of “illegal behavior” and “terrorism”, substantiates the position on the need to achieve the proper level of effectiveness of measures aimed at counteracting the illegal behavior of a terrorist orientation in society. An integral study of illegal behavior has been carried out, taking into account the existing negative and positive components, since this phenomenon acts as one of the fundamental factors that determine social progress. The article pays particular attention to the most effective way of implementing the directed action of the state to counter illegal behavior of a terrorist orientation - administrative and legal, which determines the construction of the public administration system in order to ensure that it is possible to act in an effective way in general and at various levels of the subsystems that form it appropriately to this threat. The authors summarize the need for targeted activities to organize the process of improving administrative and legal means of countering terrorism in a comprehensive manner in the legal and organizational spheres. The article substantiates the idea of the need to achieve a proper level of coherence and effectiveness of the activities of States in relation to understanding the legal nature of the acts under study, since each specific fact of illegal behavior of the form under study is not only domestic, but also international in nature." @default.
