• W4288012750 abstract "В статье нормы уголовного законодательства, предусматривающие ответственность за совершение преступлений экстремистской направленности, анализируются относительно деяний, составляющих законодательное определение экстремистской деятельности: насильственное изменение основ конституционного строя и (или) нарушение территориальной целостности РФ; публичное оправдание терроризма; возбуждение социальной, расовой, национальной или религиозной розни; пропаганда исключительности, превосходства либо неполноценности человека по признаку его социальной, расовой, национальной, религиозной или языковой принадлежности или отношения к религии; нарушение прав, свобод и законных интересов человека и гражданина в зависимости от его социальной, расовой, национальной, религиозной или языковой принадлежности или отношения к религии; воспрепятствование осуществлению гражданами их избирательных прав и права на участие в референдуме или нарушение тайны голосования; воспрепятствование законной деятельности государственных органов, органов местного самоуправления, избирательных комиссий, общественных и религиозных объединений или иных организаций, соединенное с насилием либо угрозой его применения; совершение преступлений по мотивам, указанным в п. «е» ч. 1 ст. 63 УК РФ; использование нацистской атрибутики или символики; публичные призывы к осуществлению указанных деяний либо массовое распространение заведомо экстремистских материалов, их изготовление или хранение в целях массового распространения; публичное заведомо ложное обвинение лица, замещающего государственную должность РФ или государственную должность субъекта РФ, в совершении им в период исполнения своих должностных обязанностей деяний, указанных в настоящей статье и являющихся преступлением; организация и подготовка указанных деяний, а также подстрекательство к их осуществлению; финансирование указанных деяний либо иное содействие в их организации, подготовке и осуществлении. Сформулирована корректировка термина «экстремизм» в антиэкстремистском законе и уголовно-правовых норм, предусматривающих ответственность за общественно опасные деяния в данной сфере. The article analyzes the norms of criminal legislation providing for liability for the commission of crimes of an extremist nature regarding the actions constituting the legislative definition of extremist activity: violent change in the foundations of the constitutional order and (or) violation of the territorial integrity of the Russian Federation; public justification of terrorism; incitement of social, racial, national or religious discord; propaganda of exclusivity, superiority or inferiority of a person on the basis of his social, racial, national, religious or linguistic affiliation or attitude to religion; violation of the rights, freedoms and legitimate interests of a person and a citizen, depending on his social, racial, national, religious or linguistic affiliation or attitude to religion; obstruction of citizens' exercise of their electoral rights and the right to participate in a referendum or violation of the secrecy of voting; obstruction of the lawful activities of state bodies, local self-government bodies, election commissions, public and religious associations or other organizations, combined with violence or the threat of its use; commission of crimes for the reasons provided for by Item (f) of the first part of Article 63 of the Criminal Code of the Russian Federation; the use of nazi paraphernalia or symbols; public calls for the implementation of these acts or mass distribution of knowingly extremist materials, their production or storage for the purpose of mass distribution; public knowingly false accusation of a person holding a public office of the Russian Federation or a state position of a constituent entity of the Russian Federation of committing acts specified in this article and which are a crime during the performance of his official duties; organization and preparation of the said acts, as well as incitement to their implementation; financing of these acts or other assistance in their organization, preparation and implementation. The author formulates the correction of the term “extremism” in the anti-extremist legislation and criminal law norms providing for responsibility for socially dangerous acts in this area." @default.
