Проводится анализ правовых норм, регулирующих досудебное производство по делам о государственных преступлениях в рассматриваемый период. Исследуются противоречия, возникавшие в правоприменительной практике при реализации процессуальных норм, установленных Уставом уголовного судопроизводства 1864 г., при производстве по делам о государственных преступлениях. Аргументируется авторский вывод о причинах передачи предварительного расследования преимущественного числа дел о государственных преступлениях из компетенции органов судебной власти Отдельному корпусу жандармов. Рассматриваются различия в процессуальных правах общей полиции при производстве дознаний по делам об общеуголовных преступлениях и чинов Отдельного корпуса жандармов при производстве дознаний по делам о государственных преступлениях. Вскрываются причины и сущность упрощенчества при производстве формальных и охранных дознаний чинами Отдельного корпуса жандармов. Проводится анализ содержания ведомственного руководства жандармским дознанием по делам о государственных преступлениях. Дается оценка процессуальных прав обвиняемого при производстве дознания. Анализируются статистические данные, характеризующие результативность дознаний, проводимых чинами Отдельного корпуса жандармов. Проводится сопоставительный анализ точек зрения представителей юридической науки и правоприменительной практики на последствия упрощенчества в досудебном производстве по делам о государственных преступлениях. Based on the study of written historical sources, the analysis of the works of historians of the national state and law, the article examines some of the main features of the proceedings on state crimes in Russia at the turn of the 19th and 20th centuries. The analysis of the legal norms regulating pre-trial proceedings in cases of state crimes in the period under review is carried out. The contradictions that arose in law enforcement practice during the implementation of procedural norms established by the Charter of Criminal Proceedings 1864, during the proceedings on state crimes, are investigated. The author's conclusion about the reasons for the transfer of the preliminary investigation of the predominant number of cases of state crimes from the competence of the judicial authorities to the Separate Corps of Gendarmes is argued. The differences in the procedural rights of the general police in the conduct of inquiries in cases of ordinary crimes and the ranks of the Separate Corps of Gendarmes in the conduct of inquiries in cases of state crimes are considered. The reasons and essence of simplification in the production of formal and security inquiries by the ranks of the Separate Corps of Gendarmes are revealed. The analysis of the content of the departmental management of the gendarmerie inquiry in cases of state crimes is carried out. The assessment of the procedural rights of the accused during the investigation is given. Statistical data characterizing the effectiveness of inquiries conducted by the ranks of the Separate Corps of Gendarmes are analyzed. A comparative analysis of the points of view of representatives of legal science and law enforcement practice on the consequences of simplification in pre-trial proceedings in cases of state crimes is carried out." @default.
