Method used in this research is normative legal research with statute approach. In normative point of view, the results of this study indicate that a legal framework has been specially developed to ensure the protection of indigenous peoples’ rights to prevent land disputes due to plantation investment in their traditional territory through the Plantations Law No. 39 of 2014 and Forestry Law No. 41 of 1999. However, the implementing policies have still encountered barriers due to lack of recognition and legal protection by the regional government, which is the reason indigenous land disputes keep on occurring. Indigenous land dispute settlement can be done through litigation and non-litigation. It is a form of legal action based protection by the state, but it has not been implemented efficiently, even though the government and the companies are responsible for providing efficient dispute settlement approach and mechanism that prioritize the values of justice for indigenous peoples. Therefore, there must be a regulation that govern the protection of indigenous peoples’ in a comprehensive and holistic manner. The state and the companies should, in carrying out plantation investment activities, pay attention to every aspect of human rights.</em></pre><pre><em><br /></em></pre><p><strong>Bahasa Indonesia Abstrak: </strong>Sengketa lahan masyarakat hukum adat akibat adanya investasi perkebunan di wilayah adat mereka masih kerap terjadi di Indonesia. Penelitian ini bertujuan untuk menjawab pertanyaan akademis mengenai perlindungan berbasis pencegahan untuk menghindari terjadinya sengketa lahan masyarakat hukum adat terkait dampak adanya investasi perkebunan di wilayah adat mereka dan perlindungan berbasis penindakan oleh negara dalam hal sengketa telah terjadi. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan peraturan perundang-undangan. Hasil penelitian menunjukan bahwa pemerintah telah memberikan pengakuan dan perlindungan berbasis pencegahan bagi hak ulayat masyarakat hukum adat dalam hal adanya investasi perkebunan yang mengharuskan menggunakan lahan adat mereka yang diatur dalam UU No. 39 Tahun 2014 tentang Perkebunan dan UU No. 41 Tahun 1999 tentang Kehutanan, namun dalam implementasinya masih menghadapi berbagai kendala sehingga menyebabkan sengketa terjadi. Kendala tersebut disebabkan masih banyak pemerintah daerah yang belum memberikan pengakuan dan perlindungan kepada masyarakat hukum adat dalam instrumen hukum di daerahnya. Penyelesaian sengketa dapat dilakukan melalui peradilan dan non peradilan. Hal tersebut adalah bentuk perlindungan berbasis penindakan oleh negara, namun belum dijalankan secara efisien, padahal pemerintah maupun perusahaan bertanggung jawab dalam menyediakan mekanisme penyelesaian sengketa yang efisien dan mengedepankan nilai-nilai keadilan bagi masyarakat hukum adat. Oleh karena itu harus ada peraturan yang secara tegas yang mengatur perlindungan masyarakat hukum adat secara komprehensif dan holistik. Negara dan pelaku usaha sebaiknya dalam menjalankan kegiatan investasi perkebunan harus tetap memperhatikan aspek-aspek HAM.</p>" @default.
