The applicant, John Doe, was told in 1995 that he was rejected for employment because of his health status. In 1996, the Board was persuaded to stop making pre-employment HIV inquiries regarding HIV status but continued to require applicants to furnish a complete medical history and undergo a medical exam. According to the Lambda Legal Defense and Education Fund, this 1996 policy violated the Americans with Disabilities Act (ADA). To settle the case, the Board agreed not to require applicants to submit to the medical exam unless they have a conditional offer of employment.
