- W4306959340 abstract "배우자상속은 피상속인, 배우자, 혈족상속인, 상속채권자 등 다수의 이해관계인이 등장하는 매우 복잡한 문제로, 이에 대하여 누구나 납득할 수 있는 방안을 제시하는 것은 사실상 불가능하다. 배우자상속에 관한 논의에서 (배우자)상속의 근거에서 출발하여 관련당사자들의 이해충돌을 직시하며 기존의 제도를 기반으로 한 해결책을 모색해야 하고, 그것을 기반으로 입법론적 제안으로 나아가야 한다. 필자가 이 글에서 제안한 내용을 정리하면 다음과 같다: 배우자상속의 근거는 혼인 중 형성된 실질적인 공유재산의 청산과 생존배우자의 생활보장에 있다; 관련당사자들의 자기결정을 존중하고, 특히 혈족상속과 배우자상속의 긴장관계를 고려하여 이해의 조정을 도모해야 한다; 배우자의 가사노동이 자기희생으로 치부되어서는 안 되고, 기회비용과 지출의 절약이라는 측면에서 파악되어야 한다; 해석론으로 청산의 측면에서 특별수익과 기여분을 유기적으로 이해해야 하고 상속재산의 분할에서 가정법원이 후견적 재량을 발휘해야 하며, 부양의 측면에서 혼인공동체의 연장효로서 사별이 없었다면 누렸을 생활환경과 생활수준이 유지되어야 한다; 입법론으로 현행의 상속분 5할 가산을 유지하면서 이와 선택적으로 ｢혼인재산｣의 청산 또는 부양분(부양의무의 연장)의 청구 및 잔여재산의 ‘균분’의 방향으로 나아가야 한다.It is necessary to re-examine the spouse's inheritance in consideration of the inherent problems of the current legal system and the rapid change in the environment surrounding inheritance. Spouse’s inheritance is a very complex problem in which multiple stakeholders including decedent, blood line inheritance(s), and creditor(s) of decedent appear. And it is virtually impossible to suggest a method that anyone can agree on. The discussion on spouse’s inheritance starts from the basis for (spouse’s) inheritance, confronts the conflict of interest of the parties concerned, seeks a solution based on the existing system, and moves on to a legislative proposal based on that. My suggestion in this paper is as follows: The spouse’s inheritance is based on the liquidation of the actual common property formed during marriage and the guarantee of the living of the surviving spouse; Reconciliation of interests should start from the self-determination of the parties concerned, and in particular, the tension between blood kinship and spouse inheritance should be considered; The spouse's housework should not be regarded as self-sacrifice, but should be viewed in terms of opportunity cost and cost savings; As de lege lata, special benefit and contributory portion should be correlatively understood in relation to the liquidation, and the family court should exercise its guardianship discretion in the division of inherited property. As to support, on the other hand, the standard of living that would have been enjoyed should be maintained; As de lege ferenda, while maintaining the current 50% addition to the inheritance share, it is necessary to selectively liquidate ‘marital property’ or claim support portion (extension of support duty) and move toward ‘equal share’ of the remaining property." @default.
