Данный вид наказания вызывает большое количество противоречий, так как, с одной стороны, любое наказание должно способствовать перевоспитанию осужденного, с другой стороны, исправление в данном случае трудно достижимо. Таким образом, назначение такого вида наказания должно исходить из принципа разумности и справедливости. В исследовании определяются категории пожизненного лишения свободы, случаи, в которых пожизненное заключение не применяется, признаки, характеризующие его как наказание. В статье проведен анализ применения пожизненного лишения свободы в зарубежных странах, определены сходства и различия систем данных стран. Пожизненное лишение свободы имеет особое значение, поскольку зачастую является наиболее строгой мерой уголовного наказания в странах, где смертная казнь не применяется. Большинство осужденных к пожизненному лишению свободы испытывают страдания, с связи с потерей связей с семьей и обществом, что подчеркивает необходимость более глубокого рассмотрения данной проблемы и выработки средств постепенного движения от более строгих к менее строгим условиям содержания. This article examines the practice of life imprisonment as a form of punishment in Russia and foreign countries. This type of punishment causes many contradictions, as on the one hand any punishment should contribute to the re-education of the convicted person, on the other hand the correction in this case is difficult to achieve. Thus, imposition of this type of punishment should be based on the principle of reasonableness and fairness. The study defines the categories of life imprisonment, cases when life sentence is not applied and the characteristics which characterise it as punishment. The article analyses the application of life imprisonment in foreign countries and defines the similarities and differences between the systems of these countries. Life imprisonment has a special meaning because it is often the severest measure of criminal punishment in the countries where death penalty is not applied. The majority of those sentenced to life imprisonment will experience suffering due to the loss of family and community links, highlighting the need to look more deeply into the issue and develop a means of progressively moving through the system from more restrictive to less restrictive conditions of detention." @default.
