- W4309967202 abstract "A decision is as good as its implementation and what matters to victims is that decisions are complied with. This chapter assesses conducive and impeding factors with respect to implementation of decisions rendered by AU and ECOWAS mechanisms. Decisions covered in this chapter were selected among cases IHRDA has litigated before three AU mechanisms and ECOWAS Court of Justice. As the main actor in international law, the State plays a paramount role in implementation. Drawing from the recent political developments in Benin and The Gambia, this study reveals that implementation is more likely to occur when there is democracy in the implementing State. Political change can be a good opportunity to engage States on implementation. When there is political will States implement swiftly monetary orders as required payments can only be disbursed by the Executive Branch of Government. When complying with decisions requires legislative process, the implementation takes much longer as bills need to be drafted and debated at various levels. Also, the implementation takes longer when the impugned violations are treated in the framework of transitional justice as the process by its nature has to situate the violations in the global context that enabled them and goes beyond individual cases. Implementation can be impeded by many factors including the lack of domestic legal framework enabling local courts to enforce supranational decisions, the sensitivity of issues at stake such ethnic discrimination in Mauritania, child marriage and inheritance rights in Mali and electoral competition in Benin. Victims and their representatives can generate more pressure on States by engaging adjudicatory bodies on implementation issues. Thus, the study shows that Mauritania granted identity documents to 37 victims after their representatives requested a referral of implementation to the African Court. Engaging intergovernmental political organs can also be helpful even though the engagement with ECOWAS Commission has not yet yielded positive results. The existing CSOs platforms - ECOSOCC and WACSOF- can also be used to boost advocacy towards implementation. Further, victims and litigants should explore the possibility of amicable settlements especially when the respondent State is willing to carry out the needed changes." @default.
