The Council of State has ruled in a negative way on the issue of the efficiency of the validation of public contracts created by article 11 of the July 20th 2005 Act and that were signed before that date without satisfying such formalities. Case law now gradually fashions the consequences of finding these contracts unlawful. One decision of the Council of State should particularly be emphasized.
