The researcher studied the validation, the narrations and the terms of this Hadith. Furthermore, the researcher studied the learned deduction; the shortening of the traveler’s prayer following the resident. The well-Known Hadith that is said to Ibn Abbas: What if a traveler prays two separately and four following a resident? He said this is Sunnah. Such term “this is Sunnah” is not validated and its defendants mentioned it like (be in Makah) or (stay in Makah) and the question is not restricted to collective prayer but to travelling in general and staying in Makah. Most narrations related to missing collective praying like (missing collective praying when in Albathaa) or (while with you and retuned praying two) not related to the present Hadith, but is dealt with (missed Friday praying) or like what In Aljawzi mentioned: reference is to Aleid prayer. Also results indicate that the mention of Ibn Abbas from Sunnah is not conclusive evidence on relating the Hadith to prophet Mohammad. Thus, this issue is controversial; followers correlate certain actions to Sunnah not prophet’s Sunnah e.g., Omar’s judges to Sunnah, Ali Ibn Abi Talib correlation of judges to Sharia, correlating followers’ actions to Sunnah and Amr ibn Elass’s correlating the waiting period of the boy mother to Sunnah. Results showed the predominance of the correctness of shortening the traveler prayers following a resident based on the general principle of shortening prying during travel which is general and no evidence to make it particular. Also, asymmetry between Imam and Mamoum doesn’t spoil praying as asserted in the praying of traveler as they prayed following prophet Mohammad while he was a traveler and they were residents. The study recommends to consider the all mentions and terms of the present Hadith to reach more accurate judge and consider the easier judge as not contradicting the constants." @default.
