Анализируются объективные и субъективные причины, способствующие возникновению следственной (процессуальной) ошибки на различных стадиях досудебного производства. При этом делается акцент на том, что следственные (процессуальные) ошибки, допускаемые при производстве по данной категории уголовных дел, имеют стратегический, тактико-криминалистический, процессуальный и правовой характер, дается их правовая оценка и называются причины их возникновения. Отмечается наличие связи следственной (процессуальной) ошибки с профессиональным риском в работе следователя и предлагаются варианты его поведения, способные снизить возможность возникновения следственной (процессуальной) ошибки в ходе возникновении рискованной ситуации при выполнении следователем профессиональной деятельности. Методы: анализ, обобщение, сравнение, описание, системный анализ. Выводы: Следственные (процессуальные) ошибки по уголовным делам, которые в силу закона могут быть рассмотрены присяжными заседателями, носят стратегический и тактический характер. Следственные ошибки возникают по объективным и субъективным причинам. Эти же причины формируют явно обвинительный уклон в деятельности следователя - психологическую установку направить уголовное дело с обвинительным заключением в суд. The article is devoted to the study of the issues of investigative (procedural) errors in criminal cases, which, by virtue of the law, can be considered by a court with the participation of jurors. The article analyzes objective and subjective reasons contributing to the emergence of investigative (procedural) errors at various stages of pre-trial proceedings. At the same time, the emphasis is placed on the fact that investigative (procedural) errors made during the production of this category of criminal cases have a strategic, tactical-forensic, procedural and legal nature, and their legal assessment is given and the reasons for their occurrence are called. It is noted that there is a connection between an investigative (procedural) error and an occupational risk in the work of an investigator and suggests options for his behavior that can reduce the possibility of an investigative (procedural) error during the occurrence of a risky situation when an investigator performs professional activities. Methods: analysis, generalization, comparison, description, system analysis. Conclusions: Investigative (procedural) errors in criminal cases, which, by virtue of the law, can be considered by jurors, are strategic and tactical in nature. Investigative errors arise for objective and subjective reasons. The same reasons form a clearly accusatory bias in the investigator's activity - a psychological attitude to send a criminal case with an indictment to court." @default.
