- W4313351321 abstract "Whether they are intended to promote or restrict climate interest, climate change regulatory measures implemented in host states may lead to investment treaty disputes. Ordinarily, these disputes are framed as a conflict between the investor’s private interest against the host state’s public interest. However, this portrays only one of the dimensions in which interests interplay in investment treaty law (private dimension). The system could also be envisaged as a conundrum of global public interests interacting with each other (global public dimension). Accordingly, investment treaty-climate change disputes could be defined as conflicts and synergies between the global public interest of climate, on the one hand, and the global public interest of transnational investment on the other. Yet tribunals seem to ignore the influence of the international climate change law on these disputes, giving rise to a fragmentary approach that has to be overcome if we are to harmonize the climate change international legal framework with the investment treaty law. The harmonization of these two systems could be achieved through a positivist approach, either by balancing the antagonism between the host state and the investor by interpreting investment treaties—bilateral investment treaties (BITs)—in the context of climate change (orthodox approach) or by relying on the direct application of the climate change international legal framework to investment treaty-climate change disputes (heterodox approach). The embracement of the climate change international legal framework in investment treaty disputes is a logical consequence of envisaging the system’s operation as inseparable from its environment and necessary for its survival." @default.
