If we all discharge our duties, rights will not be far to seek. If leaving duties unperformed we run after rights, they will escape us like will-o-the-wisp, the more we pursue them, the farther they will fly.” When we consider Gandhian ideas within the frame of prisons and rehabilitation of prisoners, the alternative for penal reform was that criminals can be rehabilitated in the society through moral force of dharm and non-violence. According to him it’s the duty of the society to reform and rehabilitate criminals, as once a criminal has served their time, they have to ultimately re-join society with the aim of being a functional and productive human being which can only be achieved if society at large also accepts them back. As Gandhi’s method aimed to win not by overwhelming but by converting his opponent—or as the Gandhians say, by bringing about a “change of heart” and also his philosophy that hate the crime, not the criminal. For doing this open prison system is a remarkable innovation in the realm of correctional treatment which provide an offender greater freedom with natural surroundings and lesser tension which culminate in creating an atmosphere conducive to reform himself and to achieve social, moral and economic development in the society. In view of changing nature of the Indian socio political structure this paper is an attempt to analyse the idea of establishment of open prison in India which is new in a structural sense but old in functional sense and based upon Gandhian philosophy as an alternative for penal reforms also to consider the role morality plays in reforming the society. With the advent of technology and the evolution of societal norms, new obligations have arisen that members of the society owe to each other and to the country. Along with that, certain duties that are essential to any democracy need to be reinforced within the current context so as to initiate a new sense of civic responsibility." @default.
