• W4313457355 abstract "В статье анализируются вопросы использования криминалистической идентификации в раскрытии, расследовании и предупреждении преступлений, совершаемых в условиях учреждений уголовно-исполнительной системы. Указаны факторы пенитенциарной среды, детерминирующие своеобразие материальных следов указанных преступлений. Рассмотрены теоретические основы идентификации как частной криминалистической теории и метода поисково-познавательной деятельности. Отмечено, что при расследовании преступлений, совершаемых в условиях уголовно-исполнительной системы, криминалистическая идентификация приобретает особую значимость, обусловленную спецификой конкретного исправительного учреждения. Сделан вывод о том, что наиболее информационно емким следовым комплексом, который впоследствии становится объектом приложения идентификационного метода, характеризуются последствия побегов, совершаемых из учреждений уголовно-исполнительной системы. Исследованы правовые и организационные аспекты назначения и производства судебных экспертиз, в наибольшей степени востребованных в современных условиях. Указано на особое значение идентификационных исследований в рамках молекулярно-генетической экспертизы объектов, имеющих биологическую природу. На примере фоноскопической идентификации проанализированы правовая природа, а также вопросы организации изъятия образцов для сравнительного исследования. Указано на недопустимость подмены процессуальной процедуры оперативно-розыскными мероприятиями в целях получения сравнительных образцов. На основе обобщения опыта использования технических средств визуального контроля указано на перспективу широко применения криминалистической идентификации по признакам внешности в ходе проведения видеотехнической судебной экспертизы. The article analyzes the issues of the use of forensic identification in the disclosure, investigation and prevention of crimes committed in the conditions of institutions of the penal system. The factors of the penitentiary environment determining the originality of the material traces of these crimes are indicated. The theoretical foundations of identification as a private forensic theory and a method of search and cognitive activity are considered. It is noted that during the investigation of crimes committed in the conditions of the penal enforcement system, criminalistic identification acquires special significance due to the specifics of a particular correctional institution. It is concluded that the most informative trace complex, which subsequently becomes the object of the application of the identification method, is characterized by the consequences of escapes committed from institutions of the penal system. The legal and organizational aspects of the appointment and production of forensic examinations, which are most in demand in modern conditions, are investigated. The special importance of identification studies in the framework of molecular genetic examination of objects of biological nature is indicated. On the example of phonoscopic identification, the legal nature, as well as the issues of organizing the seizure of samples for comparative research, are analyzed. It is indicated that it is unacceptable to replace the procedural procedure with operational investigative measures in order to obtain comparative samples. Based on the generalization of the experience of using technical means of visual control, it is indicated that the prospect of widespread use of forensic identification on the basis of appearance in the course of video forensic examination." @default.
