The highest court in Poland acquitted a judge who denied, in front of public authorities, that he had driven a car in excess of the speed limit. According to the Supreme Court, the judge was executing his right of defence. The arguments against the reasoning of the SC include the fact that the judge was in a relationship of subordination in terms of competencies, therefore he was obligated to comply with the request to provide the particulars of a driver who had been speeding. The lie was assessed in terms of a serious disciplinary tort. This is justified by the illocutionary and perlocutionary consequences of the judge’s written statement, as well as the performative contradiction of the person who, as a representative of the law, in fact breaks the law. We consider these aspects in two parts of the article separately." @default.
