Restorative Justice aims to empower victims, perpetrators, families and communities to correct an unlawful act by using awareness and belief as a basis for improving social life explaining that the concept of Restorative Justice is basically simple. In carrying out health actions by health workers, namely nurses and midwives, it is possible for negligence to occur which can be fatal to the patient's soul and body, in legal or medical terms it is called malpractice. In article 29 of Law no. 36 of 2009 concerning health states that In the event that a health worker is suspected of negligence in carrying out his profession, the negligence must first be resolved through mediation. In accordance with article 29 of Law Number 36 of 2009 concerning health that health workers who are suspected of being negligent in carrying out their profession, the negligence must be resolved first through mediation, therefore many people prefer a settlement through restorative justice. The purpose of this research is to find out how the application of the concept of Restorative Justice to malpractice cases that occurred at Hospital X in Riau based on Law Number 36 of 2009. The results obtained are the results of the settlement of malpractice cases between victims and perpetrators with the concept of Restorative Justice.&#x0D; Abstrak. Keadilan Restoratif adalah model penyelesaian mengedepankan pemulihan terhadap korban, pelaku, dan masyarakat. Prinsip utama Restorative Justice adalah adanya partisipasi korban dan pelaku, partisipasi warga sebagai fasilitator dalam penyelesaian kasus, sehingga ada jaminan anak atau pelaku tidak lagi mengganggu harmoni yang sudah tercipta di masyarakat. Restorative Justice memiliki tujuan untuk memberdayakan para korban, pelaku, keluarga, dan masyarakat untuk memperbaiki suatu perbuatan melawan hukum dengan menggunakan kesadaran dan keinsyafan sebagai landasan untuk memperbaiki kehidupan bermasyarakat menjelaskan bahwa konsep Restorative Justice pada dasarnya sederhana. Dalam pelaksanaan tindakan kesehatan oleh tenaga kesehatan yaitu perawat maupun bidan tidak menutup kemungkinan untuk terjadinya kelalaian yang berakibat fatal untuk badan maupun jiwa pasiennya dalam istilah hukum atau medis disebut malpraktik. Pada pasal 29 Undang-Undang No. 36 tahun 2009 tentang kesehatan disebutkan bahwa “Dalam hal tenaga kesehatan diduga melakukan kelalaian dalam menjalankan profesinya, kelalaian tersebut harus diselesaikan terlebih dahulu melalui mediasi.” Sesuai dengan pasal 29 UU Nomor 36 tahun 2009 tentang kesehatan bahwa tenaga kesehatan yang diduga melakukan kelalaian dalam menjalankan profesinya, kelalaian tersebut harus diselesaikan terlebih dahulu melalui mediasi, oleh karena itu banyak orang yang lebih memilih melakukan penyelesaian melalui restorative justice. Tujuan dilakukannya penelitian ini adalah untuk mengetahui bagaimana penerapan konsep Restorative Justice terhadap kasus malpraktik yang terjadi di Rumah Sakit X di Riau berdasarkan Undang-Undang Nomor 36 tahun 2009.
