Settlement through sharia arbitration is an option, but it has very basic problems and becomes the main problem related to the procedures for executing Basyarnas decisions. Laws and regulations should be structured in a structured manner and not contradictory, so that there is a clear and definite basis for law enforcers to carry out the implementation and enforcement of the law. The clash between the laws governing the authority of the General Courts and the Religious Courts makes a difference in the field, because there are differences in regulations. The differences that arise from legal experts and legal practice create a polemic that should not have occurred, due to legal uncertainty. The condition of the Religious Courts itself which has just received the authority to handle disputes based on Law no. 3 of 2006, has not been seen competent because historically the Religious Courts have been dwarfed since the Dutch era, so that the authority of the District Courts in granting fiat executions is not easy to eliminate in the atmosphere of thought of legal actors in Indonesia. This study discusses and examines the laws and regulations that form the basis for the execution of the Basyarnas decision based on the principle of lex posteriori derogat legi priori. The research methodology used is normative juridical research. This study uses data sources in the form of primary data and secondary data, and applies qualitative research in conducting data analysis Keywords: Sharia Dispute, Basyarnas, fiat execution, lex posteriori derogat legi priori Abstrak Sengketa syariah yang terjadi antara para pihak tidak selalu harus diselesaikan di muka pengadilan. Penyelesaian melalui arbitrase syariah merupakan suatu pilihan, namun memiliki permasalahan yang sangat mendasar dan menjadi problem utama terkait tata cara atau prosedur ekseskusi putusan Basyarnas. Seharusnya peraturan perundang-undangan disusun secara terstruktur dan tidak bertentangan, sehingga menjadi dasar yang jelas dan pasti bagi para penegak hukum untuk menyelenggarakan pelaksanaan dan penegakan hukum. Benturan antara Undang-Undang yang mengatur kewenangan Peradilan Umum dan Peradilan Agama menjadikan perbedaan implementasi di lapangan, dikarenakan terdapat perbedaan penafsiran peraturan. Perbedaan yang timbul dari para ahli hukum dan praktisi hukum menimbulkan suatu polemik yang seharusnya tidak terjadi, dikarenakan berakibat pada ketidakpastian hukum. Kondisi Peradilan Agama sendiri yang baru mendapatkan kewenangan menangani masalah sengketa ekonomi berdasarkan UU No. 3 Tahun 2006, belum dipandang berkemampuan dikarenakan secara historical Pengadilan Agama mengalami pengkerdilan sejak era Belanda, sehingga kewenangan Pengadilan Negeri dalam memberikan fiat eksekusi tidak mudah untuk dihilangkan dalam atmosfir pemikiran para pelaku hukum di Indonesia. Penelitian ini membahas dan menelaah perundang-undangan dan ketentuan yang menjadi dasar hukum pelaksanaan eksekusi putusan Basyarnas ditinjau berdasar asas lex posteriori derogat legi priori . Metodologi penelitian yang dipergunakan adalah penelitian yuridis normatif. Penelitian ini menggunakan sumber data berupa data primer dan data sekunder, serta mengaplikasikan penelitian kualitatif dalam melakukan analisis data.
